Your privacy and rights are safeguarded so that you can purchase our products in full confidence.
Products
All products offered by Atlas & Zanzibar are described as completely as possible and in good faith. Offers and prices are valid on the day they are offered on our website. The prices indicated include VAT and any recycling contribution (Recupel).
Atlas & Zanzibar cannot be held liable for (printing) errors contained in its offers.
We offer our products on our website or in our catalogues and leaflets until stocks are exhausted. Atlas & Zanzibar does its best so that all products ordered by you would be available. However, it may happen that an item is out of stock and cannot be shipped within four days, in which case we will inform you as soon as possible and you may decide to cancel your order. We provide the latest version of map or guide for every purchase. It is possible that the photo on the site is from a previous version.
Atlas & Zanzibar cannot be held liable for any damage that might arise from the non-stock of a product.
Agreement
There is a valid agreement between you and Atlas & Zanzibar when Atlas & Zanzibar receives confirmation of your order on its website, or when Atlas & Zanzibar receives your validly completed and signed order form.
However, Atlas & Zanzibar may decide to subject the validity of the agreement to other conditions, in the case, for example, of major orders or prepayments, orders made by minors, if the order form is incomplete or incorrect, or if previous orders have not been paid.
In accordance with the Trade Practices Act, loss/damage is the responsibility of the seller. However, you must inform us of this within an acceptable period (3 weeks) after you received a shipment confirmation via e-mail or via order status on the site. Atlas & Zanzibar reserves the right to refuse your request if it does not reach us within this period. You can send your notification of non-receipt to info@atlaszanzibar.be.
Consumer law
The Belgian law on commercial practices and consumer information and protection of 14 July 1991, allows the buyer to inform the seller within 14 days of receiving the product that he/she is cancelling the purchase. The goods must be returned no later than 3 days later.
If you wish to return a product because you changed your mind, you can do so within the 7 days following receipt. If you paid in advance, we will refund your order as soon as we receive the returned item.
You will then pay all shipping costs, both those of sending and returning.
If the product you receive was not the one you ordered, or if it arrives damaged, please return it within the 7 days following receipt. If you paid in advance, we will refund your order and reimburse your shipping costs upon receipt of your returned item.
Atlas & Zanzibar may refuse or not refund returned items if the plastic packaging was opened or if the products were damaged by the customer.
Delivery
The place of delivery is the one you indicated on your order. Products in stock will be dispatched within 24 hours, barring unforeseen circumstances. If a product cannot be shipped within five working days because the product is not in stock, or for any other reason, you will be notified. However, Atlas & Zanzibar cannot be held liable for any delays.
Payment
Invoices shall be payable in cash within 14 days of the invoice date, at Atlas & Zanzibar's place of business, without discount. After this period has elapsed, they shall be in default without further notice of default. If an invoice is not paid on its due date, all other invoices pending at that time shall be immediately due and payable, and the client expressly acknowledges that it owes conventional/extrajudicial compensation equal to 15% of the outstanding balance due, with a minimum of EUR 50, excluding VAT and conventional interest amounting to 12% on an annual basis.
CUSTOMERS expressly accept that Atlas & Zanzibar will allocate intervening payments on the oldest, outstanding invoices.
Orders from outside Belgium are only accepted if paid in advance by credit card or bank transfer.
Responsibility and limitation of liability
Atlas & Zanzibar cannot guarantee that the online shop will function uninterruptedly or without errors. Atlas & Zanzibar gives no guarantees as to the results that may be obtained when using the online shop, or as to the accuracy or reliability of the information obtained via that online shop.
This site is provided by Atlas & Zanzibar on an "as is" and "as available" basis. Atlas & Zanzibar makes no representations or warranties, express or implied, as to the operation of the site, the information, content, materials, or products presented in this site. To the extent permitted by law, Atlas & Zanzibar disclaims any warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Atlas & Zanzibar shall not be liable for any damage whatsoever arising from the use of its website, including but not limited to direct, consequential or indirect damage.
Applicable law and competent jurisdiction
Belgian law applies.
Only the courts of the judicial district of Ghent will have jurisdiction.
